By submitting a nomination for a Dorian Award, you hereby grant Shainin LLC and its affiliates (collectively, “Shainin”) the right to use the name, likeness, image, logo, branding, and trademarks of the person or entity being nominated for a Dorian Award (“Nominee”) (including images of Nominee or Nominee personnel) and all photographs or videos that may be taken of Nominee or Nominee personnel in connection with the Dorian Awards. The categories of personal data for which you are being asked to consent to Shainin’s collection and use on its website and advertising/marketing materials are the following:

All five categories of personal data above, which may also include naming Nominee as a client of Shainin and a brief scope of services provided, along with images, photos or videos of Nominee or Nominee personnel, are collectively referred to as “Information.”

Your Information will be used to list the winners and finalists on our website and related marketing materials (including oral, electronic, or written promotions such as press releases, social media posts, marketing emails and other similar advertising and marketing materials). All information collected by Shainin in connection with the Dorian Awards will further be subject to the Shainin Privacy Policy, which is subject to change from time to time and located at: https://shainin.com/privacy-policy/.

If you are an individual, you represent and warrant that you have all requisite authority to act on behalf of the Nominee with respect to the matters included in this Publicity Waiver. If you are an individual or entity submitting a nomination on behalf of an individual, you represent and warrant that you have obtained all requisite authorization from the Nominee individual with respect to the matters included in this Publicity Waiver.

All matters arising out of or relating to this Publicity Waiver shall be governed by and construed in accordance with the internal laws of the State of Michigan without giving effect to any choice or conflict of law provision or rule (whether of the State of Michigan or any other jurisdiction). Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Oakland County in the State of Michigan.

Your acceptance of this Waiver provides Shainin with your express consent, without any further consideration, allowing Shainin to publicize your Information provided to Shainin in press releases, advertisements, marketing materials, social media, and on its website as set out above. You acknowledge that this consent is granted notwithstanding, and in lieu of, any restriction on publicity, trademark usage, and non-use in any service agreement between your organization and Shainin.
